Allianz Global Assistance is the registered business name for AZGA Service Canada Inc., incorporated in Ontario, Canada and having its registered office at 700 Jamieson Parkway, Cambridge, Ontario N3C 4N6, Canada.

YOUR USE OF THE APP DOWNLOADABLE TO YOUR APP- ENABLED MOBILE DEVICE (THE “ALLIANZ GLOBAL ASSISTANCE TRIPWISE APP”) IS CONDITIONED UPON YOUR COMPLIANCE WITH, AND ACCEPTANCE OF, THE FOLLOWING AGREEMENT. YOU ACKNOWLEDGE AND AGREE THAT BY CLICKING ON THE ACCEPT BUTTON OR SIMILAR BUTTONS OR LINKS AS MAY BE DESIGNATED BY ALLIANZ GLOBAL ASSISTANCE TO SHOW THESE TERMS AND/OR TO INSTALL THE ALLIANZ GLOBAL ASSISTANCE APP, YOU ARE ENTERING INTO A LEGALLY BINDING CONTRACT. YOU WILL NOT BE PERMITTED TO USE THE ALLIANZ GLOBAL ASSISTANCE APP AND THE ASSOCIATED ALLIANZ GLOBAL ASSISTANCE SERVICES UNLESS AND UNTIL YOU ACCEPT THIS AGREEMENT AND ANY OTHER RULES OR POLICIES THAT ALLIANZ GLOBAL ASSISTANCE MAY CREATE AND MAKE AVAILABLE ON ITS WEBSITE FROM TIME TO TIME.

The purpose of the present notice is to define the conditions under which Allianz Global Assistance makes its Application available to users and the conditions under which users may have access to and use the Application.

By accessing this Application and using its content, you acknowledge and agree that you have read and understood the following terms of use which Allianz Global Assistance reserves the right to modify or update at any time and agree to be bound by them. Do not use the Application if you do not agree with these terms of use.

This Application is available for information purposes only. The posting of content and access to the Application do not represent, either explicitly or implicitly, any provision of services or products by us. In particular:

International Non-proprietary Names (INN) facilitate the identification of pharmaceutical substances or active pharmaceutical ingredients. Each INN is a unique name that is globally recognized and is public property. With the INN, the pharmacist should be able to give the local name of the equivalent drugs. Drugs are delivered according to local legislation. Allianz Global Assistance makes every effort to provide the most up-to-date information in this Application, however, Allianz Global Assistance does not provide advice of any nature, and shall not be responsible for the accuracy or reliability of the information presented herein, or your reliance thereon.

Your right to make use of our app or other content appearing on it is subject to your compliance with these Terms. You may not modify, or use the Material or any other content on our Services for any purpose not permitted by these Terms. Such prohibited use violates these Terms and may be a violation of the Copyrights and/or Trademarks protected by law.

You may access and display Material and all other content displayed on our Services for noncommercial, personal, entertainment use on any computer, tablet, smart watch, or mobile device you own or control. The Material and all other content on this Service may not otherwise be copied, reproduced, republished, uploaded, posted, transmitted, distributed, or used in any way unless specifically authorized by Allianz Global Assistance. Also, decompiling, reverse engineering, disassembling, or otherwise reducing the code used in any software on this Service into a readable form in order to examine the construction of such software and/or to copy or create other products based (in whole or in part) on such software, is prohibited. You may not rent, lease, lend, sell, redistribute or sublicense the Material and/or the Services. 

All content of the Allianz Global Assistance Application is protected by copyright with all rights reserved. All rights to the screens, content and arrangement are owned by Allianz Global Assistance.  You are prohibited from copying, modifying, displaying, distributing, transmitting, redelivering through the use of "framing" technology, publishing, selling, licensing, creating derivative works or using any content, trademark or logo for any purpose. You may not save or archive a significant portion of the material appearing in or on the Allianz Global Assistance Application. All rights not expressly granted herein are reserved by Allianz Global Assistance.

To the fullest extent allowed by applicable law, all content of this Application, including, but not limited to, graphics, text and hyperlinks or references to other sites, is subject to alteration without prior notice and is provided "as is" and without warranty of any kind, express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement and freedom from computer viruses or other harmful components.

We do not warrant the adequacy, accuracy, reliability or completeness of any information on this Application and expressly disclaim any liability for any damages, however suffered by you, for errors or omissions contained herein.

We do not warrant that the functions of the Application will be uninterrupted and/or error-free, that defects will be corrected or that the Application that make them available are free from computer viruses or other harmful components. 

We expressly disclaim any liability, whether in contract, tort, strict liability or otherwise, for any direct, indirect, incidental, consequential, punitive or special damages arising out of or in any way connected with your accessing or using or inability to access or use the Application or your reliance on its content, or any failure of performance, interruption, defect, delay in transmission, computer viruses or other harmful components, or line or system failure associated with the Application, regardless of our knowledge thereof. In no event shall Allianz Global Assistance’s total liability to you for all damages (other than as may be required by applicable law in cases involving personal injury) exceed the amount you have paid for the Allianz Global Assistance App. The foregoing limitations will apply even if the above stated remedy fails of its essential purpose.

By accessing this Application, you also agree to abide by the proprietary guidelines applicable to any website accessed or hyperlinked through this Application.

You may use the Allianz Global Assistance Application for lawful purposes and in accordance with these Terms of Use.  You may not use the Allianz Global Assistance Application for any purpose that is unlawful or prohibited by these Terms of Use, to cause harm or damage to any person or entity, interfere with the proper operation of the Allianz Global Assistance Application; or to upload, post or transmit any material that violates any law, infringes on the rights of any third party or contains defamatory, libelous, abusive, obscene or otherwise objectionable material (as determined by Allianz Global Assistance in its sole discretion).

YOU AGREE TO DEFEND, INDEMNIFY AND HOLD HARMLESS ALLIANZ GLOBAL ASSISTACE AND ITS PARENTS, AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, FRANCHISEES, AGENTS, LICENSORS, BUSINESS ASSOCIATES, AND SUPPLIERS FROM AND AGAINST ANY ACTUAL OR THREATENED CLAIMS, ACTIONS OR DEMANDS, LIABILITIES AND SETTLEMENTS (INCLUDING, WITHOUT LIMITATION, LEGAL EXPENSES ON A SOLICITOR AND CLIENT BASIS) RESULTING (OR ALLEGED TO RESULT) FROM YOUR USE OF ANY ONLINE SERVICES IN ANY MANNER THAT VIOLATES OR IS ALLEGED TO VIOLATE APPLICABLE LAW OR THESE TERMS.

Allianz Global Assistance takes its responsibilities regarding the privacy of data very seriously. We understand that visitors may have concerns regarding the confidentiality and security of personal information provided to Allianz Global Assistance.  It is important to us that visitors feel confident that their personal information will be treated with the necessary degree of confidentiality. Accordingly, Allianz Global Assistance follows the 10 privacy principles set out in the Personal Information Protection and Electronic Documents Act. A summary of the 10 privacy principles are written below.

1. Accountability - We are responsible for the personal information we collect and we have designated a Privacy Officer who is accountable for our compliance with applicable privacy legislation.
2. Identifying Purposes - Before or at the time we ask an individual for personal information, we will identify the purposes for which it will be used or disclosed.
3. Consent - We require an individual’s knowledge and consent for the collection, use, or disclosure of personal information, subject to certain legally permitted exceptions.
4. Limiting Collection - We limit the collection of personal information to that which is necessary for the purposes identified to the individual.
5. Limiting Use, Disclosure and Retention - We will only use or disclose an individual’s personal information with their consent (or as required or permitted by law) and we will only retain the individual’s personal information as long as necessary for the purposes for which it was collected.
6. Accuracy - We use our best efforts to keep an individual’s personal information accurate, complete, and up-to-date.
7. Safeguards - We protect an individual’s personal information by appropriate security safeguards.
8. Openness - We will make specific, understandable information readily available to individuals about our personal information policies and practices.
9. Individual Access - Upon request and upon satisfactory identification, we will give an individual access to the existence, use, and disclosure of that individual’s personal information and the individual may request corrections of any inaccuracies in such information.
10. Challenging Compliance - An individual is entitled to contact our Privacy Officer for more information about, or to challenge our compliance with, any of these principles.

By using this Application, you agree to the collection and use of your personal information as described herein. We will only collect and use your personal information for the purpose of providing you with content or services you request through the Application and for the other purposes described herein, and only to the extent necessary for those purposes. This may include sharing your personal information with affiliates or third party service providers, but only for the purposes of providing you with the services or content you have requested through the Application, or to resolve an issue or inquiry that you have raised through the Application or with the third party or affiliate in question. Personal information collected by the Application may be transferred outside your province of residence and/or outside of Canada.

With respect to this Application, we collect information you input into the Application and information about your device, geography and usage and updates of the Application and content. We may use cookies (text files on your device) to do so. You can refuse cookies by disabling them in your browser; however, please note that doing so may affect the content and functionality of the Application. Information collected may include, geolocation, device information, and operating system/version. This information will be used to enable you to use the functionality of the Application and access the Application’s content and services.

In addition, we use Google, Inc.’s Google Analytics and Firebase, which may collect the above-described information as well as information about your usage and other device-generated information. These services monitor a user’s usage of the Application and content to generate reports and information for us. We use those reports only for our (and/or our affiliate’s) business purposes (i.e. optimization of the content you see from us, Application and content development and improvement, and other purposes provided herein). As a condition of your use of the Application, you agree to our use of these analytics services. You can access the Google Analytics privacy policy here. These policies are maintained by Google, Inc. and are subject to change without notice.

Though we make every effort to preserve an individual’s privacy, we may need to disclose personal information when required by law. In such instances, we will take the utmost care to disclose only that information that we are legally required to disclose. 

This privacy policy is developed in the context of evolving and changing law and Internet technologies. Accordingly, this privacy policy is subject to change. Any changes will be posted on this page. An individual’s continued use of this website following the posting of such changes constitutes their agreement to such changes. Any disputes relating to the Application or to these terms shall be brought before courts located in Ontario, Canada, and will be governed according to Ontario and Canadian law, on their merits, independently of the rules concerning conflicting legislation. Use of the Application indicates your express agreement to submit to the exclusive jurisdiction of those courts and further agreement that they are a convenient forum for you. 

In the event that any provision of these terms is held unenforceable, the validity or enforceability of the remaining provisions will not be affected, and the unenforceable provision will be replaced with an enforceable provision that comes close to the intention underlying the unenforceable provision.
